Acceptable Use Policy

This Acceptable Use Policy (“Policy”) is part of our Terms and Conditions (“Legal Terms”) and therefore must be read together with our main Legal Terms: https://shoplifts.store/policies/terms-of-service. If you do not agree with these Legal Terms, please do not use our Services.
Continued use of our Services implies acceptance of these Legal Terms.

USE OF THE SERVICES

When using the Services, you guarantee that you will comply with this Policy and all applicable laws.

You also acknowledge that you may not:

• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any part of the Services to you.
• Remove copyright notices or other proprietary rights from any Content.
• Copy or adapt the software of the Services, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
• Upload or transmit (or attempt to upload or transmit) viruses, trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repeated text), that interferes with the uninterrupted use and enjoyment of the Services by any party or that modifies, compromises, interrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
• Upload or transmit (or attempt to upload or transmit) any material that acts as a mechanism for collecting or transmitting information, passive or active, including but not limited to graphic interchange formats (“gif”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcm”).
• Except as may result from the standard use of search engines or web browsers, use, launch, develop, or distribute any automated system, including but not limited to spiders, robots, cheat utilities, scrapers, or offline readers that access the Services, or use or launch unauthorized scripts or other software.
• Disparage, obscure, or otherwise harm, at our discretion, us and/or the Services.
• Use the Services in a manner inconsistent with any applicable law or regulation.
• Use a purchasing agent or proxy to make purchases on the Services.
• Sell or otherwise transfer your profile.

CONTRIBUTIONS

For the purposes of this Policy, “Contributions” means:

• any data, information, software, text, code, music, scripts, sound, graphics, photos, videos, tags, messages, interactive features, or other material you post, share, upload, send, or otherwise provide in any way on or through the Services; or
• any other content, material, or data you provide to Shoplifts or use with the Services.

Some areas of the Services may allow users to upload, transmit, or post Contributions. We may, but are not obligated to, review or moderate Contributions made on the Services and expressly disclaim any liability for any loss or damage resulting from any user’s violation of this Policy. Please report any Contribution you believe violates this Policy; however, we will determine, at our sole discretion, whether a Contribution actually violates this Policy.

You represent and warrant that:

• you are the creator and owner or have the licenses, rights, consents, releases, and permissions necessary to use and authorize us, the Services, and other users of the Services to use your Contributions in any way provided by the Services and this Policy;
• all your Contributions comply with applicable laws and are original and truthful (if representing your opinion or facts);
• the creation, distribution, transmission, public display or performance, as well as access, download, or copying of your Contributions do not and will not infringe property rights, including, by way of example, copyrights, patents, trademarks, trade secrets, or moral rights of third parties; and
• you have verifiable consent, release, and/or permission from every identifiable person in your Contributions to use the name or image of each such person to allow inclusion and use of your Contributions in any way provided by the Services and this Policy.

You also agree not to post, transmit, or upload any Contribution (or part of it) that:

• violates applicable laws, regulations, court orders, contractual obligations, this Policy, our Legal Terms, a legal obligation, or promotes or facilitates fraud or illegal activities;
• is defamatory, obscene, offensive, hateful, insulting, intimidating, harassing, abusive, or threatening towards any person or group;
• is false, inaccurate, or misleading;
• it does not include material related to sexual abuse of minors or violate any applicable laws regarding child pornography or other regulations aimed at protecting minors; • it does not contain any material requesting personal information from anyone under 18 or exploit persons under 18 sexually or violently;
• it does not promote violence, support the violent overthrow of any government, or incite, encourage, or threaten physical harm against others;
• it is not obscene, lewd, indecent, violent, harassing, slanderous, defamatory, contains sexually explicit material, or is otherwise objectionable (as we determine);
• it is not discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age;
• it does not bully, intimidate, humiliate, or insult any person;
• it does not promote, facilitate, or assist anyone in promoting and facilitating acts of terrorism;
• it does not violate, or assist anyone in violating, the intellectual property, publicity, or privacy rights of others;
• it is not deceptive, does not falsely represent your identity or affiliation with any person and/or mislead anyone about your relationship with us or imply that the Contribution was made by someone other than you;
• it does not contain unsolicited or unauthorized advertising, promotional material, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation that have been “paid” for, with monetary or in-kind compensation; or
• you do not misrepresent your identity or the origin of the Contribution.

REVIEWS AND RATINGS

When your Contribution is a review or rating, you also agree that:

• you have direct experience with the goods being reviewed;
• your Contribution is truthful to your experience;
• you are not affiliated with competitors if you post negative reviews (or connected in any way, for example, being an owner or seller/producer of a product or service if you post positive reviews);
• you cannot draw or offer conclusions regarding the legality of the conduct;
• you cannot post false or misleading statements; and
• you do not and will not organize a campaign encouraging others to post reviews, positive or negative.

REPORTING A VIOLATION OF THIS POLICY

We may, but are not obligated to, review or moderate Contributions made on the Services and expressly disclaim any liability for any loss or damage resulting from a violation of this Policy by any user.

If you believe that any Content or Contribution:

• you violate this Policy, send an email to shoplifts.store@gmail.com, or refer to the contact details at the end of this document to indicate which Content or Contribution violates this Policy and why; or
• you violate third-party intellectual property rights, send an email to shoplifts.store@gmail.com.

We will reasonably determine whether Content or a Contribution violates this Policy.

CONSEQUENCES OF VIOLATING THIS POLICY

The consequences of violating our Policy will vary based on the severity of the violation and the user's history on the Services, by way of example:

In some cases, we may provide you with a warning and/or remove the violating Contribution; however, if your violation is serious or if you continue to violate our Legal Terms and this Policy, we have the right to suspend or terminate your access and use of our Services and, if applicable, disable your account. We may also inform law enforcement or initiate legal action against you when we believe there is a real risk to a person or a threat to public safety.

We exclude our liability for any action we may take in response to any violation of this Policy by you.

REPORTING AND REMOVAL OF LEGITIMATE CONTENT

If you believe that some Content or Contributions have been mistakenly removed or blocked by the Services, please refer to the contact details at the end of this document and we will promptly review our decision to remove such Content or Contributions. The Content or Contributions may remain "invisible" during the review process.

DISCLAIMER

Shoplifts has no obligation to monitor user activities
and disclaims all liability for any misuse of the Services by users. Shoplifts
has no responsibility for any user or other Content or Contributions created, maintained, stored, transmitted, or accessible on or through the Services, and is not obligated to monitor or exercise any editorial control over such material. If Shoplifts becomes aware that any Content or Contribution violates this Policy, Shoplifts may, in addition to removing such Content or Contribution and blocking your account, report such violation to the police or the competent regulatory authority. Unless otherwise stated in this Policy, Shoplifts disclaims any obligation towards anyone who has not entered into an agreement with Shoplifts for the use of the Services.
